The number of the gas turbine generator packages is two and two optional.Indicatively each package will be complete with:— Jet derivative gas turbine;— Electrical generator;— Gas turbine inlet filter;— Gas turbine enclosure complete with fire detection and firefighting systems for indoor installation;— Lubricating system for the turbine and for the driven generator;— Control cabinet for start-up, control speed, load;— Delivery to site, full installation on site, commissioning, start-up, testing and training— All associated ancillary systems, start-up and commissioning spare parts.

Applications for admission to bargaining with announcement, called hereinafter the “Application”, should be submitted according to the following rules:

1. Documents for Candidates (an additional documents for Economic Operators of an informative character eg. templates of statements, tables and answers to the questions about prequalification stage) are available on the following website: http://polska.edf.com/edf-w-polsce/przetargi

2. The present procedure are subject to provisions of the Rules of Preparing and Conducting Contract Award Procedures Based on EU Directive by Companies of EDF Group in Poland (Rules) available on the website: http://polska.edf.com/edf-w-polsce/przetargi/regulaminy-94698.html

3. The procedure shall be held in English language. The Contract Notice and other documents are available only in English language.

4. Application must be accompanied by all documents and statements referred in this Contract Notice. Application form must be signed by an authorized representative of the Economic Operator or Economic Operators jointly applying for participation in the procedure. Power of attorney to sign the Application has to be attached to the Application if the authorization to represent the Economic Operator is not clear from other documents submitted with the Application (e.g. registration documents). The contents of the power of attorney should clearly identify scope of the authorization. A power of attorney shall be submitted in writing (original) or in a copy certified by a notary public.

5. Application form and other annexes should be completed according to the requirements established in the Contract Notice without changing the contents of these documents. Contracting Entity allows to submit the documents on the forms prepared by the Economic Operators, provided that their contents and information will correspond to requirements established in the contract notice or the entry forms specified by the Contracting Entity. If the Economic Operator runs out of space in the annexes, such annexes must be accompanied with additional pages. Each page of the Application and the annexes should be numbered.

6. The Economic Operators should submit documents, other than a power of attorney referred to in these requirements, in the form of original or photocopies certified as true copy by the Economic Operator. Certification as a true copy should be made in the manner allowing for identification of the signature (e.g. along with the personal stamp of the person certifying the copies with the original if possible). In the case of a document in language other than English, the Economic Operators shall include a translation into English.

7. If an Application is made jointly by several Economic Operators, such Economic Operators should obey the rules mentioned in Section III.1.3) of the Contract Notice.

8. The Application with attachments must be legible, drawn in a written form, in English for its original hard copy. All pages of the application and documents submitted with the application should be numbered consecutively. The Application should be filed in a package preventing the content from being viewed before the expiry of the deadline for submitting applications. A package must bear a stamp or note containing the Economic Operator's name and registered address and the following “Supply of two gas-turbines for EDF Toruń S.A. and an option for two additional gas-turbines to CHPs belonging to EDF Polska Group”

9. The hardcopy shall obligatorily be submitted in the following manner: in English and its copy in an electronic form (on a CD version of the application containing scan of the original hardcopy along with the written application) in the “pdf” format. In case of any differences in the contents between the counterparts submitted in electronic and hardcopy versions, the Contracting Entity will take into account the hardcopy for the purpose of the evaluation. Written Application and any of its copies, as well as the electronic Application shall indicate the reference number of this proceeding CK/UE/LEA/2013-06-17/01.

10. The information contained in the Application, which is the secret of the company within the meaning of the Act of 16 April 1993 on combating unfair competition, which the Economic Operators has reserved no later than the deadline for submission of Applications, that may not be available, must be submitted in a separate envelope marked clause: “Do not share - information constituting a business secret in the meaning of Article 11 sec. 4 of the Act on combating unfair competition”.

11. Contracting Entity shall qualify to the next step of the tender procedure all Economic Operators who meet the participation requirements:

13. Conducting of the procedure was entrusted to a representative: EdF Polska S.A.

14.In the case of amounts denominated in currency other than euro, to confirm the fulfilment of the conditions stipulated in Section III.2.2), the stated amounts should be converted from such currency into the euro equivalent at the European Central Bank's mid exchange rate of the date of publication of this notice in the Official Journal of the European Union – stating the value in euro (and if the European Central Bank's mid exchange rate of the date of publication of this notice in the Official Journal of the European Union is not available, the stated amounts should be converted from the other currency into the euro equivalent at the European Central Bank's mid exchange rate prevailing most recently before the date of publication of this notice).

15. Any additional statements, notifications and information shall be provided by the Contracting Entity and Economic Operators in writing, email or by fax.

16. Contracting Entity shall conduct the bargaining procedure in cycles and reserve the right to reduce the number of Economic Operators after each such cycle based on conditions defined in the invitation to the particular bargaining cycle.

17. In order to fulfil the conditions for participation in the contract award procedure, the Economic Operator may rely on other entities, irrespective of the nature of their legal relationship, as per conditions determined in the contract notice. In such case, the Economic Operator is required to prove to the Contracting Entity that he shall dispose of the resources necessary to perform the contract, in particular by presenting to this end a written commitment of those entities whereby they undertake to put the necessary resources at the Economic Operator's disposal for the time of their use in performance of the contract. The Contracting Entity may require that the entity which the Economic Operator relies upon in respect of the fulfilment of conditions for participation in the award procedure shall take part in the execution of the contract as a subcontractor. Should the above mentioned third entity not meet terms and conditions for participation in the procedure, the Contracting Entity shall be entitled to communicate this fact to the Economic Operator and call him to present a subcontractor who would satisfy the Contracting Entity's requirements, under pain of excluding this Economic Operator from the procedure. Such entities shall provide representations and documents listed in item III.2.1. herein: I –IV.

18. The Contracting Entity may require from the Economic Operators to make representations or submit documents confirming that Economic Operator and his subcontractors meet conditions for participation in the procedure at each stage of the tender proceeding.

19. Any time prior to the selection of the most advantageous tender, the Contracting Entity may require Economic Operators to enable him to perform a technical, financial and organizational audit in order to examine and confirm whether a given Economic Operator or his subcontractors dispose of indispensable resources ensuring proper execution of the contract. A negative result of this audit or refusal to undergo the audit may lead to exclusion of the Economic Operator from the procedure.
