Zdolności techniczne i zawodowe:

1) Participation in the procedure may be applied for by economic operators, which are not excluded and meet the conditions for participation in the procedure, related to:

1.1) technical or professional capability, i.e.:

1.1.1) have knowledge and experience related to supplies corresponding to the subject of the public contract, i.e.: during the last 3 (three) years before the tender submission deadline, and if the period of their business activity is shorter – during such a period, has provided or still provides at least 3 supplies of ready to use CALM buoys;

1.1.2) have facilities enabling servicing of equipment corresponding to the subject of the public contract.

2) Meeting the aforementioned conditions for participation in the procedure shall be based on declarations and documents specified in p. 10 SETC. If the aforementioned procedure participation conditions are not met, the situation shall provide the basis for economic operator exclusion, with the exception of art. 26 p. 3 and 4 of the Act.

Wykaz i krótki opis zasad i kryteriów:

1) The contracting authority shall exclude economic operators from the procedure on the basis of art. 24 p. 1 of the act;

2) The contracting authority shall exclude economic operators indicated in art. 24 p. 5 point 1) and 8) of the Act from the procedure;

3) Detailed information may be found in the point 8 of SETC.

Realizacja zamówienia
Wymagane depozyty i gwarancje:

1) Submission of a deposit according to art. 45 of the Act in the amount of 342 000,00 PLN shall be a condition for participation in the procedure;

2) Deposits submitted in cash, as bank transfers, should be transferred to the bank account of the contracting authority, indicated in p. 2 SETC. The transfer reference should indicate ‘deposit (wadium) – The procurement of a CALM buoy.’

The deposit should be credited to the account of the contracting authority before the tender submission deadline. It is recommended to attach an electronic copy of a confirmation of the deposit transfer to the tender.

3) Detailed information may be found in the SETC.

W przedmiotowym postępowaniu wpłynęły 2 oferty następujących firm: 1) The Monobuoy Company Ltd.; 2) Imodco Terminals SA; Podlegające odrzuceniu na podstawie art. 89 ust. 1 pkt 1) ustawy. W uzasadnieniu czynności, o której mowa w pkt 1) powyżej należy wskazać, iż Wykonawca (firma The Monobuoy Company Ltd.) złożył ofertę opatrzoną niekwalifikowanym podpisem elektronicznym. Zgodnie z punktem 16.4 Specyfikacji Istotnych Warunków Zamówienia oraz treścią art. 10a ust. 5 ustawy oferty, sporządza się, pod rygorem nieważności, w postaci elektronicznej i opatruje się kwalifikowanym podpisem elektronicznym. Brak prawidłowego podpisu (w tym przypadku elektronicznego kwalifikowanego podpisu) na ofercie powoduje, iż w świetle prawa jest ona nieważna. W uzasadnieniu czynności, o której mowa w pkt 2 powyżej należy wskazać, iż Wykonawca (firma Imodco Terminals SA) złożył ofertę w formie skanu nie podpisując jej elektronicznie kwalifikowanym podpisem. Analogicznie jak w przypadku w punkcie 1) taka oferta w świetle prawa jest nieważna. W związku z powyższym obie oferty podlegają odrzuceniu z uwagi na ich niezgodność z ustawą (art. 89 ust. 1 pkt 1) ustawy). Mając powyższe na uwadze Zamawiający unieważnia postępowanie na podstawie art. 93 ust. 1 pkt 1) ustawy w związku z faktem, iż nie złożono żadnej oferty niepodlegającej odrzuceniu.

W przedmiotowym postępowaniu wpłynęły 2 oferty następujących firm:

1) The Monobuoy Company Ltd.;

Podlegające odrzuceniu na podstawie art. 89 ust. 1 pkt 1) ustawy.

W uzasadnieniu czynności, o której mowa w pkt…

… 1) powyżej należy wskazać, iż Wykonawca (firma The Monobuoy Company Ltd.) złożył ofertę opatrzoną niekwalifikowanym podpisem elektronicznym. Zgodnie z punktem 16.4 Specyfikacji Istotnych Warunków Zamówienia oraz treścią art. 10a ust. 5 ustawy oferty, sporządza się, pod rygorem nieważności, w postaci elektronicznej i opatruje się kwalifikowanym podpisem elektronicznym. Brak prawidłowego podpisu (w tym przypadku elektronicznego kwalifikowanego podpisu) na ofercie powoduje, iż w świetle prawa jest ona nieważna.

… 2 powyżej należy wskazać, iż Wykonawca (firma Imodco Terminals SA) złożył ofertę w formie skanu nie podpisując jej elektronicznie kwalifikowanym podpisem.

Analogicznie jak w przypadku w punkcie 1) taka oferta w świetle prawa jest nieważna.

W związku z powyższym obie oferty podlegają odrzuceniu z uwagi na ich niezgodność z ustawą (art. 89 ust. 1 pkt 1) ustawy).

Mając powyższe na uwadze Zamawiający unieważnia postępowanie na podstawie art. 93 ust. 1 pkt 1) ustawy w związku z faktem, iż nie złożono żadnej oferty niepodlegającej odrzuceniu.
