The Ordering Party requires that within each of these contracts, at least 7 students were recruited in one academic year. Note The Ordering Party defines 1 service as 1 contract. For example, if a contract is concluded for a period longer than one academic year and 7 students are recruited in each academic year, the Ordering Party will consider that one service (contract) has been fulfilled. The Contractor whose tender will be awarded the highest mark, in order to prove that he meets the conditions for participation in the procedure (specified by the Ordering Party in Chapter VIII of the SWZ), pursuant to Article 126 item 1 of the act, will be requested to submit the following subjective evidence (valid as at the date of submission): 3.1 a list of services conducted and, in the case of periodic or continuous services, also performed in the last 3 years, and if the period of contractor’s’ activity is shorter - in this period, together with their value, subject, dates of performance and entities for which the services were performed or are performed, and the attachment of evidence indicating whether these services were performed or are performed duly. Note! 1. The Contractor is obliged to submit, along with the offer, two separate statements regarding the absence of grounds for exclusion and the fulfillment of participation conditions in the proceedings, as indicated by the Ordering Party, as referred to in Article 125 item 1 of the Pzp (Public Procurement Law). The statements serve as evidence confirming the lack of grounds for exclusion of the Contractor and the fulfillment of participation conditions in the proceedings on the day of submitting the offers, temporarily replacing the individual means of proof required by the Ordering Party, as indicated in the SWZ. 1) The first declaration regarding non-exclusion is based on Article 5k of Regulation 833/2014 as amended by Regulation 2022/576, and regarding non-exclusion under Article 7 item 1 of the Act of April 13, 2022, on special measures to counter support for aggression against Ukraine and to protect national security - a template of such a declaration is provided in Attachment No. 8 to the SWZ. 2) The second declaration regarding non-exclusion, meeting the participation conditions, is submitted on the standard European Single Procurement Document (ESPD), form, drawn up in accordance with the standard form specified in Commission Implementing Regulation (EU) 2016/7 of January 5, 2016, establishing the standard form for the European Single Procurement Document, hereinafter referred to as "ESPD". 2. The Ordering Party shall, prior to selecting the most advantageous tender, invite the Contractor whose tender has been rated the highest to submit, within a specified period not less than 10 days, updated, as of the date of submission, the following documentary evidence: 2.1. Information from the National Criminal Register issued not earlier than 6 months before its submission, concerning: 1) specified in section 1 points 1.1 and 1.2 of CHAPTER VII of the SWZ (Article 108 item 1 points 1 and 2 of the Pzp), concerning final convictions for specified crimes, and 2) specified in section 1 point 1.4 of CHAPTER VII of the SWZ (Article 108 item 1 point 4 of the PZP). 2.2. The Contractor's statements concerning the scope indicated in section 1 point 1.5 of CHAPTER VII of the SWZ (Article 108 item 1 point 5 of the PZP), regarding the lack of affiliation with the same capital group within the meaning of the Act of February 16, 2007, on Competition and Consumer Protection with another Contractor who submitted a separate offer in the proceedings, or a statement of affiliation with the same capital group along with documents or information confirming the independent preparation of the offer from another Contractor belonging to the same capital group. The Contractor may prepare the statement according to the template provided in Attachment No. 7 to the SWZ. 2.3. 2) An appeal against the content of the notice initiating the contract award procedure or against the content of the procurement documents shall be lodged within 10 days from the date of publication of the notice in the Official Journal of the European Union or the publication of the procurement documents on the website.
3) Appeal in cases other than those specified in point 1) and 2) shall be submitted within 10 days from the date on which the information on the circumstances constituting the basis for its submission was taken or could have been taken with due diligence - in the case of orders.
4) If the ordering party has not sent the contractor notice of the selection of the most advantageous tender, the appeal must be filed no later than:
a) 30 days from the date of publication of the contract award notice in the Official Journal of the European Union,
b) 6 months from the date of conclusion of the contract, if the ordering party has not published a contract award notice in the Official Journal of the European Union;
