A. Rules of qualification for the further stage the proceedings (invitation to submit tenders)

1. The Contracting Entity after evaluating requests for admission to participate in this proceeding will invite 20 Economic Operators fulfilling the conditions set by the Contracting Entity to submit tenders. The Contracting Entity will evaluate the fulfilment of the conditions on the basis of the rule fulfils / does not fulfil.

2. If the number of Economic Operators who fulfil the conditions for participation in proceedings will be greater than 20, the Contracting Entity will grant additional points according to the rule described below:

one point will be granted for each additional service (over the required quantity) performed under the rules described in Section III 2.3) point I.1. of the notice, the proper execution of which has been confirmed by the Economic Operator in the manner specified in Section III.2.3), point II.1. of the notice. The first 20 Economic Operators ranked in the order from the highest to the lowest number of points will be invited to submit tenders. In the event that a few Economic Operators

will receive the same number of points, the greater number of services referred to in Section III 2.3) point I.2. of the notice will decide about the qualification of the Economic Operator.

3. An request submitted in original for admission to participate in the proceedings with appendices should be signed by the legally empowered representative /s of the Economic Operator, authorized to undertake commitments on its behalf, according to the entry about representation in a relevant document entitling to appear in legal transactions or according to the granted power of attorney. A power of attorney in the form of the original or a copy certified for compliance with the original by a notary should be attached to the request, if empowerment does not result from other documents attached by the Economic Operator.

4. The request of the Economic Operator for admission to participate in the present proceedings conducted under the procedure of restricted tender, the appendix of which will be statements, information and required documents should be submitted in written form, and appendices should be arranged in the order as in Section III.2.1. — III.2.3. of the notice it is recommended that the request together with appendices will be connected in one piece and pages will be consecutively numbered.

5. It is recommended to prepare the request for admission to participate in the proceedings with appendices in accordance with the model placed on the website of the Contracting Entity (Appendix No. 8 to the notice, placed on the website www.przetargi.pgnig.pl).

6. The Economic Operator may submit together with the request its copy in electronic form — uneditable on a data carrier, with reservation that in case of discrepancy between the original and the electronic copy the content of the original is assumed as binding

7. All documents are to be submitted in the form of the original or a copy certified by the Economic Operator for compliance with the original (in the case of documents that must be submitted in original this information results directly from the content of this contract notice). In case of documents related to particular Economic Operators acting jointly and documents related to third entities which make resources available to the Economic Operator the copies of such documents may be certified for compliance with the original by duly empowered representatives of these entities, or by representatives of the Economic Operator / Economic Operators acting jointly (Contracting Entity recognizes both of the above mentioned forms as proper).

8. Contracting Entity expresses consent to submit requests for admission to participate the contract award, statements, information, and other documents in Polish or in English language. The Contracting Entity allows submission of an offer and appendices in English language, with reservation that at least the Request (pursuant to Appendix No. 8) and all statements will be translated into Polish language. The signature under the documents should enable identification of the signing person.

9. The packaging with the request should be secured against accidental opening. On the packaging there must be placed the address of the Contracting Entity pursuant to Section I.1) of the notice and the address of the Economic Operator, at which the request must be returned in the case of its receipt by the Contracting Entity after the deadline for submission of requests, and the annotation: Request for admission to participate in the public proceedings under the name:

‘ Acquisition, processing and interpretation of seismic data by the passive seismic method in the area of LMG’, file reference number: ZP/PGNG/15/0270/GE/DGG.

10. In accordance with Article 27 sub-paragraph 1 of the Public Procurement Law Act the correspondence between the Contracting Entity and the Economic Operators will be transferred by fax at the number: +48 226918921 or by electronic means to the address: justyna.czuprynska@pgnig.pl. Each of the Parties at the request of the other Party shall immediately confirm the fact of receipt of statements, requests, notifications and information and documents transmitted by fax or electronic means. The written form, subject to the exceptions provided for in Public Procurement Law Act is always permissible.

11. The Economic Operator has right to reserve the information constituting a company secret. For the effectiveness of the reservation made such information must be included separately from the non-confidential information so that the Contracting Entity from the day of informing the Economic Operators on results of assessing the fulfilment of conditions of participation in the proceedings will be able to make available for review the part of the request, which is non-confidential, without disclosing the content constituting a company secret. It is therefore advisable to place such information in a separate envelope, while the statement of the Economic Operator (it is advisable to draw up the statement based on the model made available on the website of the Contracting Entity: www.przetargi.pgnig.pl — Appendix No. 9 to the request for admission to participate in the proceedings for the award of the contract) should be found in the non-confidential part of the request. Failure to enclose a statement by the Economic Operator will be considered as a lack of will to keep secret any data making up the request for admission to participate in the proceedings.

The Contracting Entity requires that the Economic Operator reserving a part of the request for admission to participate in the proceedings as a company secret will demonstrate no later than within the time limit for submission of requests that the proprietary information constitute a company secret.

12. The Contracting Entity will recognize the information reserved by the Economic Operator as a company secret according to the criteria specified in Article 11sub- paragraph 4 of the Act of April 16, 1993 on combating unfair competition (consolidated text: Polish Journal of Laws /Dz.U./ of 2003 No. 153, item. 1503, as amended) if the Economic Operator, not later than within the time limit for submission of requests, will demonstrate that:

proprietary information constitutes a technical, technological, organizational information of the company, or other information undisclosed to the public,

proprietary information has an economic value,

it will describe what actions necessary to preserve the confidentiality of proprietary information have been undertaken by it.

13. In order to evaluate the fulfilment of the conditions specified in Section III.2.3.) of the notice the Contracting Entity will convert the values given in currencies other than the Polish zloty according to the average exchange rate of the Polish National Bank /NBP/ binding on the date of the contract notice. If the publication of a contract notice in the Official Journal of the European Union will take place on the day on which the National Bank Polish does not publish the table of average exchange rates the Contracting Entity will take as a base the exchange rate from the table of average exchange rates published on the nearest day after the day of publication of this contract notice in the Official Journal of the European Union.

14. The Contracting Entity has not applied the technical dialogue in the present proceedings.

15. Before the deadline for submission of the request the Economic Operator has the right to ask a question regarding clarification of the content of the notice.

16. The information about submission of the request for admission to participate in the proceedings may be passed on by phone before expiration of the deadline for submitting requests to participate in the proceedings. The request is deemed to have been submitted on time, before the expiry of the deadline for submitting requests for admission to participate in the proceedings it has been sent in written form and the Contracting Entity has received it not later than within the time limit of 7 days from the date of expiry of the deadline for submission of requests.

The Contracting Entity informs that it will require, that the Economic Operator, with which the agreement will be signed will have throughout the whole time of execution of works a current insurance policy for civil liability in the range of the conducted economic activity for the insurance sum not less than the value of the concluded agreement.

The remuneration for the works performed will be paid to the Economic operator by bank transfer on the basis of invoices properly issued and delivered to the Contracting Entity, within 21 days from the date of delivery together with the attached the Protocol of quantity survey of Works signed without reservations by both parties to the agreement.
