1. The subject of the contract includes, in particular:
1) conducting an on-site inspection of the installation site for the system for receiving and processing data from polar-orbiting satellites, as well as presenting detailed conditions for the preparation by the Contracting Authority of the infrastructure necessary for the system installation;
2) supply, installation, configuration, and commissioning of a system consisting of: a. a receiving antenna with data reception components such as a feedhorn, converter, cabling, antenna control system, b. a receiver/demodulator compatible with the antenna, c. computer hardware for data processing, d. software;
3) granting/supply of software licences;
4) conducting system tests and commissioning the system for operational use
5) supply of the system’s technical documentation
6) conducting training for system users and administrators;
7) granting a warranty and providing technical support services.

Warunki otwarcia ofert (Informacje o osobach upoważnionych i procedurze otwarcia)

1. Submitted bids will be simultaneously decrypted and opened via the procurement platform available at the website address indicated above, in accordance with the procedure described in Chapter XV of the Tender Specifications (TS). 2. The contractor is bound by the bid for 90 days from the deadline for submission of bids, with the first day of the binding period being the day on which the deadline for submission of bids expires, i.e., until 23.11.2025.

1. Contract award may be sought by Contractors who meet the participation conditions concerning:
1) the capacity to act in commercial transactions – the Contracting Authority does not specify a requirement in this regard;
2) the authorizations to conduct a specific business or professional activity, if required by separate regulations – the Contracting Authority does not specify a requirement in this regard. 3) economic or financial situation - The Contracting Authority does not specify a condition in this regard;
4) Technical or professional capacity – Contractors who have completed, and in the case of recurring or continuous services are also performing, within the last 3 (three) years counted backward from the deadline for submitting bids, or if the period of business activity is shorter – during that period, at least 1 contract involving the supply, installation, and servicing of stations for receiving and processing polar-orbiting satellite data from meteorological or environmental satellites.
2. Before selecting the most advantageous bid, the Contracting Authority shall request the Contractor whose bid has been evaluated highest to submit, within a specified time limit of not less than 10 days, evidence valid as at the date of submission confirming that the Contractor meets the conditions for participation in the procedure relating to technical or professional capacity - List of supplies made, and in the case of recurring or continuous services also performed, during the last 3 years, counting backwards from the date on which the deadline for submission of bids expires, and if the period of activity is shorter - during that period, together with their subject matter, dates of performance and entities for which the supplies were made or are being made, and attaching evidence confirming that these supplies have been or are being performed properly, whereby the evidence referred to shall be references or other documents drawn up by the entity for which the supplies were made, and in the case of recurring or continuous services, are being performed, and if the Contractor, for reasons beyond its control, is unable to obtain these documents - Contractor's statement – the list form is attached as Appendix No. 8 to the TS.
In the case of recurring or continuous services, references or other documents confirming their proper performance should be issued within the last 3 months, counting backwards from the date on which the deadline for submitting bids expires.

Wymagane depozyty i gwarancje

1. The Contracting Authority requires Contractors to submit a bid security of PLN 100,000.00.
2. Detailed information on the deposit is provided in Chapter XIII of the TS.

Warunki realizacji zamówienia

1. The contracting authority requires a performance bond. The contracting authority shall establish a security deposit in the amount of 5% of the total price specified in the tender. Detailed security information is provided in Chapter XIX of the TS.
2. The public procurement contract to be concluded between the Contracting Authority and the Contractor shall be drawn up based on the model contract constituting Appendix No. 10 to the TS.
3. The Contracting Authority reserves the right to amend the provisions of the contract concluded with the Contractor in justified circumstances.
4. Any changes to the content of this agreement must be made in writing to be valid.
5. The possibility of amending the provisions of the concluded agreement, as provided for in section 3, covers in particular the situations specified in §17-19 of the Model Agreement constituting Appendix No. 10 to the TS.

1. The Contracting Authority shall exclude from the procedure any Contractors in relation to whom there are circumstances constituting grounds for exclusion as set out in: Article 108 of the PPL, Article 109(1)(4) of the PPL, Article 5k(1) of Council Regulation (EU) No 833/2014 of July 31, 2014 concerning restrictive measures in view of Russia’s actions destabilizing the situation in Ukraine, and Article 7(1) of the Act of April 13, 2022 on special measures for counteracting the support of aggression against Ukraine and for the protection of national security.
2. The Contractor is required to attach to the tender a declaration of not being subject to exclusion from the procedure. These declarations are made by the Contractor on: 1) the Single European Procurement Document form, prepared in accordance with the standard form template specified in Commission Implementing Regulation (EU) 2016/7 of January 5, 2016, establishing the standard form of the Single European Procurement Document (Official Journal of the EU L 3 of 01/06/2016, p. 16), hereinafter referred to as the “single document” — the Single European Procurement Document form constitutes Appendix No. 2 to the TS. 2) the form constituting Appendix No. 3 to the TS - Additional declaration of non-exclusion from the proceedings.
3. To confirm that the offered supplies meet the requirements and characteristics specified by the Contracting Authority in the Description of the Subject of the Contract - Technical Specification, the Contracting Authority requires Contractors to submit the following evidence: Description of the subject of the contract - Technical Specification confirming that the item offered by the Contractor meets the requirements specified by the Contracting Authority, prepared in accordance with Appendix No. 1 to the TS. The Contractor shall submit the evidence referred to in the previous sentence together with the bid.
4. Before selecting the most advantageous bid, the Contracting Authority shall request the Contractor whose bid received the highest score to submit, within a specified deadline of no fewer than 10 days, evidence of eligibility valid as of the date of submission, in order to confirm the absence of grounds for exclusion from the procedure: a) an extract from the National Criminal Register regarding: – Article 108(1)(1) and (2) of the PPL; – Article 108(1)(4) of the PPL concerning a ruling imposing a ban on applying for public contracts as a criminal sanction, issued no earlier than six months prior to its submission; b) with respect to Article 108(1)(5) of the PPL: – a statement by the Contractor confirming that they do not belong to the same corporate group, within the meaning of the Act of February 16, 2007 on Competition and Consumer Protection (i.e. Journal of Laws of 2024, item 1616), as any other Contractor that has submitted a separate bid; or – a statement confirming affiliation with the same corporate group, together with documents or information demonstrating that the bid was prepared independently from the other Contractor belonging to the same group. d) a statement confirming the accuracy of the information contained in the declaration referred to in Article 125(1) of the PPL, regarding the exclusion grounds indicated by the Contracting Authority, as specified in: – Article 108(1)(3) of the PPL; – Article 108(1)(4) of the PPL concerning a ruling imposing a ban on applying for a public contract as a preventive measure; – Article 108(1)(5) of the PPL concerning agreements with other Contractors intended to distort competition; – Article 108(1)(6) of the PPL. e) a statement confirming non-exclusion on the basis of Article 7(1) of the Act of April 13, 2022 on Special Measures to Counteract the Support of Aggression Against Ukraine and to Protect National Security, and on the basis of Article 5k(1) of Council Regulation (EU) No. 833/2014 of July 31, 2014 concerning restrictive measures in response to Russia’s actions destabilizing the situation in Ukraine. 1. The appeal shall be lodged within:
1) 10 days from the date of delivery of the information regarding the Contracting Authority’s action constituting the basis for filing the appeal, if the information was delivered using electronic means of communication;
2) 15 days from the date of delivery of the information about the Contracting Authority’s action constituting the basis for filing the appeal, if the information was delivered by means other than those specified in point 1.
2. Appeals against the content of the notice initiating the procedure or against the content of the tender documents shall be lodged within 10 days of the date of publication of the notice in the Official Journal of the European Union or of the tender documents on the website.
3. Appeals in cases other than those specified in sections 1 and 2 shall be lodged within 10 days of the date on which the circumstances giving rise to the appeal became known or could have become known with due diligence.
