The subject-matter of the contract is the purchase and delivery of a real-time computer simulator of a nuclear power plant with a PWR reactor type with four steam generators with an electrical output of more than 1000 MWe, including:
1) delivery of functional software for simulating the operation of a nuclear power plant;
2) delivery of IT infrastructure (“Equipment”): 1 server, 1 Instructor station, 3 Training stations, a projector and a printer including installation, configuration and launch;
3) training in the use of simulation equipment and software, including the required materials and documentation;
4) a minimum 12-month guarantee;
5) hardware and technical support for 12 months;
6) a licence to use and apply the simulator software for an unlimited period of time and ownership of the media on which it is recorded;
7) after-sales service for a period of 24 months from the end of the warranty.

2) European Single Procurement Document (ESPD) – template in Annex No. 1 to Tender Form. In the case of submission of a joint tender in public procurement procedure, a statement on the lack of basis for exclusion shall be submitted by each Contractor;
3) A statement submitted based on Article 5k section 1 of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's destabilising action in Ukraine. 2) Article 7 section 1 of the Act of 13 April 2022 on special solutions to counter support for aggression against Ukraine and to protect national security, constituting Annex No. 1a to Tender Form. In the case of submission of a joint tender in public procurement procedure, a statement on the lack of basis for exclusion shall be submitted by each Contractor;
4) Product Specification Form – Equipment configuration of the offered Simulator constituting Annex No. 1b to Tender Form;
5) A power of attorney authorising the submission of the tender if the tender is submitted by a proxy;

7) (if applicable) ­ A power of attorney for the proxy to represent the Contractors submitting of a joint tender in public procurement procedure – applicable to tenders submitted jointly;
8) (if applicable) ­ A commitment of the entity making resources available, constituting Annex No. 3 to Tender Form ;

2. Before selecting the most advantageous tender, the Contracting Authority shall call upon the Contractor whose tender was awarded the highest evaluation score to submit, within a time limit no shorter than 10 days, the following contractor-related evidence confirming that there are no grounds for excluding the Contractor from participation in the procedure, up-to-date as at the date of submitting the tender:
1) information from the National Criminal Register as regards: Article 108 section 1 item 1 and 2 of the PPL Act and Article 108 section 1 item 4 of the PPL Act, concerning an order for prohibition on applying for a public procurement contract as a criminal measure, issued no earlier than 6 months before its submission,
2) statement of the Contractor, within the scope of provisions of Article 108 section 1 item 5 of the PPL Act, on not being a member of the same capital group as defined by the Act on Competition and Consumer Protection of 16 February 2007 (Journal of Laws of 2020, item 1076 and 1086) with another Contractor who submitted a separate tender, a partial tender, or a statement on being a member of the same capital group together with documents or information confirming preparation of a tender, a partial tender independently of another Contractor belonging to the same capital group. The Contracting Authority recommends that the statement should be prepared in accordance with the template constituting Annex No. 5 to Tender Form,
3) an excerpt or information from the National Court Register or the Central Register and Information on Business, within the scope of Article 109, section 1, item 4 of the PPL Act, prepared no earlier than 3 months before submission if separate regulations require entry in the register or records. 4) A statement of the Contractor on the validity of information included in the statement, referred to in Article 125 section 1 of the PPL Act (ESPD), within the scope of grounds for exclusion from the procedure indicated by the Contracting Authority, as referred to in article 108 section 1 item 3 - 6 of the PPL Act, it is recommended to prepare the statement according to the template constituting Annex No. 4 to Tender Form.
3. If the Contractor has registered office or place of residence outside the borders of the Republic of Poland, instead of:
1) information from the National Criminal Register as referred to in item 7.2 subpoint 1, the Contractor shall submit information from a relevant register, such as a court register, or, in the absence of such a register, another equivalent document issued by a competent judicial or administrative authority of the country in which the Contractor has their registered office or place of residence or the place of residence of the person to whom the information or document refers, to the extent referred to in item 7.2 subpoint 1) - issued no earlier than 6 months before its submission;
2) an extract or information from the National Court Register or from the Central Register and Information on Business referred to in item 7.2. subpoint 3) - the Contractor shall submit a document or documents issued in the country in which they have their registered seat or place of residence, confirming respectively that they have not been liquidated, declared bankrupt, their assets are not managed by a liquidator or a court, they have not made an arrangement with creditors, their business activity is not suspended nor are they in any other such situation resulting from a similar procedure provided for in the legislation of the place where that procedure is initiated. ­ issued no earlier than 3 months before their submission.
3) If in the country in which the Contractor has their registered seat or where the person to whom the document relates has their place of residence, the documents referred to in item 7.3 subpoint 1) and 2) are not issued, or if such documents do not refer to all cases referred to in art. 108 section 1 item 1, 2 and 4, they shall be replaced in full or in part, respectively, by a document containing a declaration of the Contractor, indicating the person or persons authorised to represent them, or a statement of the person to whom the document applies, submitted under oath, or, if there are no regulations on declarations under oath in the country in which the Contractor has its registered seat or the place of residence of the person to whom the document applies, submitted before a judicial or administrative authority, a public notary, a professional or economic self-government authority competent as regards the seat or the place of residence of the Contractor or the place of residence of the person to whom the document applies - issued within the time limits referred to in item 7.3, subpoint 1) and 2), respectively.

4. Information on subject-matter evidence:
1) To confirm that offered supplies meet the requirements have features specified by the Contracting Authority, the Contractor shall attach to the tender: Annex No. 1b to Tender Form ­ Product Specification Form – Equipment configuration of the offered Simulator
2) Subject-matter evidence shall be submitted before the expiry of the deadline for tender submission
3) Should the Contractor fail to submit subject-matter evidence with the tender or the submitted evidence be incomplete, the Contracting Authority shall request its submission or completion within a specified deadline.

The Contracting Authority shall award the Contractor with an advance payment no higher than 50% of remuneration specified in § 2 section 1 item 1) of the agreement within 28 days of the date of submitting a written request for an advance payment, subject to the prior provision of a security for the repayment of the advance payment in the form of an insurance guarantee or a bank guarantee, in an amount equal to 100% of the granted advance payment, which the security is intended to cover. The validity of the security shall not expire earlier than within 30 days of the date of signing the Acceptance Record of the Subject-matter of the Agreement. The content of the advance payment security document is subject to the Contracting Authority’s approval. The advance payment security shall be unconditional, irrevocable, and payable upon the first demand of the Contracting Authority. 1. The Contracting Authority will exclude a contractor from the procurement procedure on the basis of the provisions of Article 108 section 1 item 1-6 and Article 109 section 1 item 4 of the PPL Act. 2. The Contracting Authority shall exclude from the public procurement procedure any contractor in relation to whom the circumstances apply, referred to in: 1) Article 5k section 1 of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's destabilising action in Ukraine. 2) Article 7 section 1 of the Act of 13 April 2022 on special solutions to counter support for aggression against Ukraine and to protect national security.

1. Appeal deadlines are specified in Article 515 of the PPL Act. In the case of contracts whose value is equal to or does not exceed EU thresholds, this deadline shall be:
1) within 10 days of forwarding the information on the Contracting Authority’s actions constituting basis for making an appeal provided this information has been forwarded via electronic means of communication; or
2) within 15 days of forwarding the information on the Contracting Authority’s actions constituting basis for making an appeal provided this information has been forwarded in a manner other than that specified in subpoint 1).
2. An appeal against the content of the announcement initiating the contract award procedure or against the content of public procurement documents shall be made: within 10 days of the publication of the announcement in the EU Official Journal or placement of public procurement documents on the website.
3. In the cases other than those specified above in item 1 and 2, an appeal shall be made: within 10 days of the day on which the circumstances giving rise to the appeal became known or could have become known with due diligence, in the case of contracts whose value is equal to or exceeds the EU thresholds.
4. If the Contracting Authority has not made a notice on the intention to conclude an agreement or, despite such an obligation, has failed to send the Contractor a notice on the selection of the most advantageous tender, an appeal shall be made no later than:
1) within 30 days of the publication of the notice on contract award in the EU Official Journal,
2) within 6 days of the date of the conclusion of the agreement provided the Contracting Authority has not published the announcement on contract award in the EU Official Journal.
5. A complaint to the court may be lodged against the ruling of the National Appeal Chamber and the decision of the President of the National Appeal Chamber referred to in Article 519 section 1 of the Act by the parties and participants of the appeal proceedings.
