Design, purchasing fabrication, transport, erection, tests and commissioning of SNCR systems on 2 OP-380 boilers units installed in Krakow CHP plant.Detailed description of the object of the Works will be included in the Contract template, Technical Specification, constituting part of Terms of Reference, which will be released to the Economic Operators qualified to participate in the tendering procedure.

Applications for admission to bargaining with announcement, called hereinafter the ‘Application’, should be submitted according to the following rules:

1. Documents for Economic Operators (an additional documents for Economic Operators of an informative character e.g. templates of statements, tables and answers to the questions about pre-qualification stage) are available on the purchase platform on following website: https://edf.eb2b.com.pl/

2. The present procedure are subject to provisions of the Rules of Preparing and Conducting Contract Award Procedures Based on EU Directive by Companies of EDF Group in Poland (Rules) available on the website: https://edf.eb2b.com.pl/cms/directory/id/regulations-and-procedures

3. The procedure shall be held in English or Polish language, at the discretion of the Contracting Authority. The Contract Notice and other documents are available in English and Polish language. Further documentation will be issued in Polish and/or English language, at the discretion of the Contracting Authority. In case of any discrepancies between the 2 language versions of the documents provided by the Contracting Authority, the Polish version shall prevail.

4. Application must be accompanied by all documents and statements referred in this Contract Notice. Application form must be signed by an authorized representative of the Economic Operator or Economic Operators jointly applying for participation in the procedure. Power of attorney to sign the Application has to be attached to the Application if the authorization to represent the Economic Operator does not result from other documents submitted with the Application (e.g. registration documents). The contents of the power of attorney should clearly identify scope of the authorization. A power of attorney shall be submitted in writing (original) or in a copy certified by a notary public.

5. Application form and other enclosures should be completed according to the requirements established in the Contract Notice without changing the contents of these documents. Contracting Entity allows to submit the documents on the forms prepared by the Economic Operators, provided that their contents and information will correspond to requirements established in the contract notice or the entry forms specified by the Contracting Entity. If the Economic Operator runs out of space in the annexes, such annexes must be accompanied with additional pages. Each page of the Application and the annexes should be numbered.

6. In the case of a document in languages other than English and/or Polish, on the awarding Entity's request the Economic Operators shall include a translation into English and/or Polish.

7. If an Application is made jointly by several Economic Operators, such Economic Operators should obey the rules mentioned in Section III.1.3) of the Contract Notice.

8. The Application with relevant attachments to the Application must be legible, drawn in an electronic form, in English or Polish for its original hard copy. All pages of the application and documents submitted with the application should be numbered consecutively.

9. The electronic version of application with documents and statements is required irrespective of the obligation to submit its hard copy. The electronic version of application shall be delivered through purchase portal eB2B (https://edf.eb2b.com.pl/): 1000498100 — ‘Design, manufacturing and installation of secondary measures (SNCR systems) on 2 OP-380 boilers at EDF Polska S.A. branch No 1 in Krakow’. Application form and other enclosures shall be submitted in scan of original document or in scan of certified true copy by the Economic Operators in the ‘pdf’ format. In case of not having access to the purchase platform, the Economic Operators must first register on the purchase platform.

10. The information contained in the Application, which is the secret of the company within the meaning of the Act of 16.4.1993 on combating unfair competition, which the Economic Operators has reserved no later than the deadline for submission of Applications, that may not be available, must be submitted in a separate envelope marked clause: ‘Do not share — information constituting a business secret in the meaning of Article 11 sec. 4 of the Act on combating unfair competition’.

11. Contracting Entity shall qualify to the next step of the tender procedure all Economic Operators who meet the participation requirements.

12. The Contracting Entity: EDF Polska S.A.

13. In the case of amounts denominated in currency other than PLN, to confirm the fulfilment of the conditions stipulated in Section III.2.2) the stated amounts will be converted by EDF from such currency into the PLN equivalent at the Narodowy Bank Polski (National Bank of Poland) mid exchange rate of the date of publication of this notice in the Official Journal of the European Union — stating the value in PLN (and if the Narodowy Bank Polski mid exchange rate of the date of publication of this notice in the Official Journal of the European Union is not available, the stated amounts will be converted by EDF from the other currency into the PLN equivalent at the Narodowy Bank Polski mid-exchange rate prevailing most recently before the date of publication of this notice).

14. Any additional statements, notifications and information shall be provided by the Contracting Entity and Economic Operators in writing, email, by fax or through purchase portal eB2B.

15. In order to fulfil the conditions for participation in the contract award procedure, the Economic Operator may rely on other entities, irrespective of the nature of their legal relationship, as per conditions determined in the contract notice. In such case, the Economic Operator is required to prove to the Contracting Entity that he shall dispose of the resources necessary to perform the contract, in particular by presenting to this end a written commitment of those entities whereby they undertake to put the necessary resources at the Economic Operator's disposal for the time of their use in performance of the contract. The Contracting Entity may require that the entity which the Economic Operator relies upon in respect of the fulfilment of conditions for participation in the award procedure shall take part in the execution of the contract as a subcontractor.

16. Any time prior to the selection of the most advantageous tender, the Contracting Entity may require Economic Operators to enable him to perform a technical, financial and organizational audit in order to examine and confirm whether a given Economic Operator or his subcontractors dispose of indispensable resources ensuring proper execution of the contract. A negative result of this audit or refusal to undergo the audit may lead to exclusion of the Economic Operator from the procedure.

17. Any time prior to the selection of the most advantageous tender, the Contracting Entity may require Economic Operators to resubmit up-to-date declarations and/or the statements confirming that he meets conditions for participation in the proceedings submitted in the course of the proceedings. If the Contracting Entity finds failure to comply by the Economic Operator on the basis of documents or refusal to submit required documents it may lead to exclusion of the Economic Operator from the proceedings.

18. In a given scope the awarding entity may many times invite the economic operator who have failed to submit the documents or representations required in the contract notice, ToR or invitation to negotiate, to submit or complete them by the date specified by the awarding entity.

Inne szczególne warunki

If the Economic Operator relies on other entities in respect of fulfilment of conditions of participation in the award procedure (knowledge and experience, technical capability, personnel capable to execute the contract and/or financial capability), the Contracting Entity requires that the entity which the Economic Operator relies upon shall take part in the execution of the contract as a subcontractor.
