The subject of the contract is the construction and finalization of design for a new class A office building planned to function as Research and Development Center with associated road and infrastructure. Therefore, the employer is looking for a general contractor to finalize the design and to construct the building and supporting required infrastructure under the general conditions of the ‘Plant and Design Build’, First Edition 1999, published by the Fédération Internationale des Ingénieurs-Conseils (FIDIC), English-Polish Edition of 2008 published by SIDIR FIDIC yellow book lump sum agreement with Intel additions and modifications.

The current status is as follows: land for the project is procured.

Building rights received for construction of the building and part of external areas as included in the tender documentation. Contractor will be responsible for acquiring all additional permits and agreements required for building completion according to tender documentation scope. Details of existing and required permits will be provided in tender documentation.

Design is advanced to tender stage and will be submitted as part of the full tender package

Building Gross Size: 27 400 m

Intelligent SMART building: Integrating IoT to create a SMART work environment

Deadline for execution of the order: 1 August 2023 — Earlier possible including LEED certification and full project closeout. Contractual penalties will apply on late completion of LEED certification.

Time for completion (as defined in contract template): 1 April 2023 as handover date for the building including granted occupancy permit (signing of taking over certificate, as defined in the contract template). Contractual penalties will apply on late completion.

A detailed description of the scope of the work to be carried out including the template of the full contract will be submitted to the contractor after signing a Corporate-Non-Disclosure-Agreement (CNDA) Contract. Full tender documentation will be available via the SAP Ariba platform.

The full tender documents for request for quotation No Doc2468607593 will be available electronically to the contractors after countersigning a Corporate-Non-Disclosure-Agreement (CNDA) with Intel in an online platform. Requests for CNDA application shall be submitted to: Procurement.Intel.Deutschland@intel.com

The employer reserves that it will expect a general minimum warranty of 36-month on the overall contract scope (the exceptions are: minimum 10 years for structural elements (except painted finishes); roofing, sealings leakage free; metal cladding; curtain walls; water proofing, weather tightness; composite concrete panels; windows and roof glazing; external louvres and minimum 5 years for: roads; skylights; sealed concrete floors); Baseline warranty 2 years.

The current design is at tender design stage (design and permitting done till current tender stage) as it will be released via the Ariba platform. The design requires further detailing prior construction (IFC and workshop drawings). The design should be developed further based on the existing design, where is the intending contractor taking over the current design after proof while tender phase including accepting liability for the existing design (with errors and omissions). Contractor needs to accept project delivery strategy, design build and absorb the responsibility for the current design.

Opis opcji:

The employer reserves the right to make significant changes to the provisions of the concluded contract in relation to the content of the offer, on the basis of which the contractor was selected in cases referred to in clauses bellows.

On the basis of which the contractor was selected, to the following extent and in situations:

Changes to the provision of the concluded contract of the time for completion:

• ‘Fossils’ — sub-clause 4.24;

• ‘Testing’ — sub-clause 7.4;

• ‘Extension of Time for Completion’ — sub-clause 8.4;

• ‘Consequences of Suspension‘ — sub-clause 8.9;

• ‘Interference with Tests on Completion‘ — sub-clause 10.3;

• ‘Consequences of Employer’s Risks’ — sub-clause 17.4;

Changes to the provision of the concluded contract of the final price:

The employer also provides for the possibility of making insignificant changes to the provisions of the concluded agreement contract in relation to the content of the offer.

Amendments to the agreement contract will be made in the form of an addendum signed by both parties, and the possibility of their introduction is subject to acceptance by the employer.

Warunki uczestnictwa
Sytuacja gospodarcza i finansowa:

1) The contractor should demonstrate that in the last 3 accounting year, he or she achieved an average net sales revenue annually of at least of PLN 120 000 000 (one-hundred-twenty Million Polish Zloty). The contractor documents the revenue with the following stated reports: balance sheet and Income statement or F01 or an analogous excerpt from the book of revenues and expenses.

How to evaluate the condition:

Attaching the supplier financial health statement including supporting formal stated balance, cash-flow and profit/loss statements of the last 3 business years.

2) The contractor has an average positive cash flow accumulated over the last 3 closed financial years.

3) The contractor must show that bank enforcement titles have not been issued against him.

This must be confirmed by an opinion from all banks or cooperative savings and credit unions in which the contractor has an account informing about the amount of turnover (amount range, e.g. eight-digit amount) on bank accounts and telling about possible enforcement titles and overdue debt (applies to all banks in which the Contractor has bank accounts) issued not earlier than three months before the deadline for submitting offers.

4) Liability insurance

The bidder must prove that he or she has:

(i) civil liability insurance in the scope of conducted activity related to the object of the order:

The guarantee sum specified in the insurance contract cannot be lower than PLN 15 000 000 (fifteen Million Polish Zloty for one and all events during the insurance period. The bidder must provide a copy of the current liability insurance policy in the scope of their business

Attaching current insurance policy to the bid.

Zdolności techniczne i zawodowe:

1) Technical or professional capacity for sustainable office buildings.

2) Technical or professional capacity for LAB and Data center environment.

3) Knowledge and experience for design as proven capability to develop design to an execution design status.

4) Knowledge and experience for IT installations.

Experience in projects with >5000 IT ports in single project (can be proven with intended named subcontractor).

5) Construction key personal experience.

According to the conditions of the enquiry, a minimum experience level for the key personals of the project team is considered. The following key personal and functions are rated and are to be required fluent in English and Polish.

(a) Project director — expected 3 years in the role and overall 10 years in construction sector

Project director — who has at least 60 months experience in managing contracts including at least 2 (two) investments with a useable net area of at least 25 000 m

(b) Design manager — expected 3 years in the role and overall 10 years in construction sector

— unlimited building licenses to design in structure and construction specialty, issued under current legislation (or corresponding licenses issued under previous legal provisions, sufficient to perform the subject of the contract). On a par with the above qualifications shall be treated a decision on recognizing professional qualifications for citizens of EU Member States;

— a total of at least 60 months experience as a designer in the in structure and construction industry, including design (alone or as a member of a design team - a person mentioned at least in the content of the project), of a construction project or projects for investments involving construction.

(c) Construction manager- proof of certification according polish law- expected 3 years in the role and overall 10 years in construction sector

— unlimited building licenses for managing of construction in structure and construction specialty, issued under current legislation (or corresponding licenses issued under previous legal provisions, sufficient to perform the subject of the contract). On a par with the above qualifications shall be treated a decision on recognizing professional qualifications for citizens of EU Member States;

— a total of at least 60 months professional experience (acquired before the deadline for submission of bids) consisting of managing (i.e. performing the function of a construction manager or works manager), including in managing one or several investments, including the construction of an office building Class A with an area of at least 25 000 m

(d) safety manager — expected 3 years in the role and overall 8 years in construction sector;

(e) commissioning manager — expected 3 years in the role and overall 10 years in construction sector;

(f) LEED manager — expected 3 years in the role and overall 8 years in construction sector;

(g) cost control — expected 3 years in the role;

(h) scheduler — expected 2 years in the role and overall 5 years in construction sector;

(i) procurement — expected 3 years in the role and overall 5 years in construction sector.

6) The bidder has a Corporate EHS policy enforced for minimum 1 year. A policy is the intentions and directions of an organization related to Environment, Health and Safety (EHS) performance (combined or separately) as formally expressed by its top management to achieve its compliance and/or commitment goals;

7) The bidder rate of recordable accidents at work as per Local Regulations in 2019 was lower than 6.2;

8) The bidder has received maximum of 5 violations, which were subject to penalty of value >PLN 20 000 each from national authorities in the past 3 years;

9) In last 12 months, the bidder reported no fatalities on the sites that they were the prime or general contractor.

How to evaluate the condition:

1) Bidder has recent (within last 5 years calculated from the date experience in successfully completing at least one sustainable office project (as LEED or equivalent sustainability standard (i.e. BREEAM) and successfully completing at least one building of equivalent size scope – min. 10 000 m

Min 1 references or other proofs, that projects (with description) are performed and completed to be provided for

• one of, as LEED or equivalent sustainability standard (i.e BREEAM) — within last 5 years;

• one of, as equivalent size scope – min. 10 000 m

2) To carry out the construction works for server labs or datacenters for projects with minimum 500 kW server electrical load (can be proven with intended named subcontractor).

Min 1 References or other proofs, that projects (with description) are performed and completed for server lab or datacenter – minimum 500 kW server electrical load within recent 5 years calculated from the date of publishing this request for quotation (In case proven by subcontractor the subcontractor to be named for references or other proofs of execution);

3) Min 2 reference projects — demonstrating execution design by either self-performed or intended design partner for office building of minimum 10 000 m

4) By providing a reference project with more than 5000 IT ports in single project (In case proven by subcontractor, subcontractor and references to be named);

5) Statement of Contractor Fulfill the condition supported by:

— short CV (including status of current engagement relationship with the contractor) of all above Key personnel to be provided with the RFQ submission;

— certificate of the construction manager to be attached to the RFQ submission.

6) Provide a copy of your corporate EHS policy enforced minimum one year before submission of the bid;

7) An accident at work is a sudden event caused by an external cause resulting in injury or death, which occurred in connection with work:

(a) during or in connection with the employee's ordinary activities or instructions from his/her superiors;

(b) during or in connection with the employee's performance of activities for the employer, even without instructions;

(c) while the employee is at the employer's disposal on the way between the employer's seat and the place of performance of the obligation arising from the employment relationship;

(d) accidents in Polish regulation, this statistic is calculated per 1000 workers (accident rate);).

The participating bidder must provide a formal confirmation that accident rate is lower than 6.2 and provide data, calculations confirming actual accident rate in 2019.

8) The participating bidder must provide a formal confirmation that they have received maximum of 5 violations, which were subject to penalty of value >PLN 20 000 each from national authorities in the past 3 years prior to publishing the request for quotation;

9) The participating bidder must provide a formal confirmation that they have reported no fatalities on the sites that they were prime or general contractor in the last 12 months prior to publishing the request for quotation.

All references required, must contain, a short description, referencing the capability requested, to evaluate and Name and contact of the reference provider.

Grounds for exclusion

1) Entities that are personally or equity-linked with the employer or via an associated party are excluded from the proceedings.

In the case of contractors jointly applying for the award of the contract, a declaration on the lack of connections with the employer shall be made by each of the contractors acting jointly.

Additionally, such a statement should be provided by named subcontractors.

Equity or partnerships shall mean the interconnectedness between the employer or persons authorized to enter into obligations on behalf of the employer or persons carrying out on behalf of the employer the activities connected with the preparation and execution of the contractor's selection procedure, and the Contractor, consisting in particular:

(a) participation in a company, as a partner of a civil-law partnership or partnership;

(b) owning at least 10 % of the shares;

(d) being married, in a relationship or affinity in a straight line, second-degree relationship or second-degree affinity in the sideline or in relation to adoption, care or guardianship.

How to assess the fulfilment of the absence of grounds for exclusion:

A Statement of Compliance need to be uploaded to the RFP Template of statement of compliance.

2) The contractor must prove that he is not in arrears with the required tax payments.

How to evaluate the condition:

The proof is the submission of a current certificate of the competent tax office confirming that the contractor is not in arrears with payment of taxes, or a certificate that he has obtained the exemption provided for by law, deferring or spreading in instalments of overdue payments or withholding in full the decision of the competent authority- issued not earlier than three months before the deadline for submitting Offers.

In order to confirm that the condition of participation in the proceedings has been met, the Contractor may rely on the experience of another entity (subcontractor), regardless of the legal relationship with him.

Note: the contractor may rely on the capacity of another entity (or entities) only if that entity (or entities) participates in the performance of the contract with the Contractor and is jointly and severally responsible for the manner and quality of the work performed. In the event that the contractor wishes to rely on the capacity of another entity (or entities), he must prove to the employer that he will have the necessary resources, presenting for this purpose an appropriate obligation of such entity or entities (an obligation to make available the necessary resources for the performance of the contract).

The contractor with his sub-contractors, who demonstrate compliance with the required conditions and the absence of grounds for exclusion, will be allowed for examination and evaluation. The assessment will meet the above conditions will be made according to the formula: 'meets – does not meet'. A Contractor who fails to comply with any of the conditions, will be rejected in the proceedings.

The subject of the contract is the construction and finalisation of design for a new Class A office building planned to function as Research and Development Center with associated road and infrastructure. Therefore, the employer is looking for a general contractor to finalise the design and to construct the building and supporting required infrastructure under the general conditions of the ‘Plant and Design Build’, First Edition 1999, published by the Fédération Internationale des Ingénieurs-Conseils (FIDIC), English-Polish Edition of 2008 published by SIDIR FIDIC yellow book lump sum agreement with Intel additions and modifications.

Design is advanced to tender stage and will be submitted as part of the full tender package.

Building gross Size: 27.4 km

Net size: 23k m

And lab space: 800 SQM High density server lab and audio lab.

Canteen (Café): 1 500 employees.

Building sustainability standard: LEED Gold.

Intelligent SMART building: Integrating IoT to create a SMART work environment.

Time for completion (as defined in contract template): 1 April 2023 as handover date for the building including granted occupancy permit (signing of Taking Over Certificate, as defined in the contract template). Contractual penalties will apply on late completion.

A detailed description of the scope of the work to be carried out including the template of the full contract will be submitted to the Contractor after signing a Corporate-Non-Disclosure-Agreement (CNDA) contract. Full tender documentation will be available via the SAP Ariba platform.

The full tender documents for Request for quotation No Doc2468607593 will be available electronically to the contractors after countersigning a Corporate-Non-Disclosure-Agreement (CNDA) with Intel in an online platform. The employer reserves that it will expect a general minimum warranty of 36-month on the overall contract scope (the exceptions are: minimum 10 years for structural elements (except painted finishes); roofing, sealings leakage free; metal cladding; curtain walls; water proofing, weather tightness; composite concrete panels; windows and roof glazing; external louvres and minimum 5 years for: roads, skylights, sealed concrete floors); Baseline warranty 2 years.

The current design is at tender design stage (Design and permitting done till current tender stage) as it will be released via the Ariba platform. The design requires further detailing prior construction (IFC and workshop drawings). The design should be developed further based on the existing design, where is the intending contractor taking over the current design after proof while tender phase including accepting liability for the existing design (With Errors and Omissions). Contractor needs to accept project delivery strategy's design build and absorb the responsibility for the current design.

In the event that the contractor wishes to rely on the capacity of another entity (or entities), he must prove to the employer that he will have the necessary resources, presenting for this purpose an appropriate obligation of such entity or entities (an obligation to make available the necessary resources for the performance of the contract).

The contractor with his sub-contractors, who demonstrate compliance with the required conditions and the absence of grounds for exclusion, will be allowed for examination and evaluation. The assessment will meet the above conditions will be made according to the formula: ‘meets — does not meet’. A contractor who fails to comply with any of the conditions, will be rejected in the proceedings.
