Scope of works covers the following sectors: renovation-construction works, water-sewage installation, mechanical ventilation, installation of medical gases, electrical installation, tele-technical installation with fire protection installation, accommodation installations.

The Ordering Party anticipates the possibility of using the option right specified in Art. 441 sec. 1 of the Act on Public Procurement
1) Considering the right of option, the Ordering Party divided the entire task (in all sectors) into: basic tasks (1 - Appendix 1b) and the remaining part the task as part of the right of option (2).
2) The Ordering Party undertakes a decision concerning realization of the task, specified via option (2) post obtaining additional financial means.
3) The final term of the Ordering Party's decision concerning realization of the task in the scope specified by the right of option shall be determined for 30.03.2024.
4) The use of the right of option does not constitute agreement modification.
5) The right of option shall be realized according to the same conditions as the basic order.
6) The Ordering Party may use the right of option in its entirety.
7) Realization of tasks in the part from the right of option must be carried out within the term contained in Chapter V of the ToR, remuneration – specified in the offer subject to the provisions contained in the draft agreement.
8) Optional order shall not constitute an obligation of the Ordering Party to grant it, nor does it constitute the basis for pursuing by the Contractor of compensation claims on account of non-realization of this order.
9) The Ordering Party shall inform the Contractor of his intention to avail of the right of option in a written form.
10) With respect to the right of option (Task 2), provisions contained in the Agreement Template, constituting Appendix no. 3 to ToR shall apply, respectively.

A) The Contractor must prove possessing at disposal (having at disposal or confirming possession in the future) of persons necessary to carry out the hereby order, that is, the condition understood as ensuring, among others, personnel with professional preparation for the conduct of independent technical functions in construction, i.e. Performing managerial positions with the below entitlements, required by the Act on Construction Law, with the required experience:
Site Manager – at least 3 years’ professional experience counted from the date of obtaining entitlements, including performance of a site manager function during at least two construction projects, construction entitlement to supervise construction works without restrictions in structural-construction specialization, association in a Construction-Engineering Chamber (valid subscription fee). Entitlements shall be understood as: construction entitlements specified in the Act of 7 July 1994 on Construction Law(Journal of Laws from 2016 item 290 as amended) and Regulation of the Minister of Transport and Construction from 28 April 2006 on independent technical functions in construction (Journal of Laws from 2006, No. 83, item 578 as amended) or equivalent to them construction authorizations issued on the basis of the previously binding provisions of law or accepted by the relevant body, in accordance with the Act of 18 March 2008 on the principles of obtaining professional qualifications obtained in member states of the European Union (Journal of Laws from 2008, No. 63, item 394) to perform independent functions in construction
Sanitary works manager – with entitlements in the scope of installation and sanitary devices.

B) The Contractor must prove that in the period of the last 5 years prior to the expiry of the term of submission of offers and if the period of conduct of business activity was shorter - in that period, he properly completed at least 2 construction works performed on a 24/7 open healthcare service object in a manner not hindering its standard functioning for the minimum value of PLN 800 000,00 each, corresponding with its type to the hereby order, that is, containing at least the works in the scope of general construction works, sanitary installation works and electrical installation works.

1. Declaration as to the scope specified in Appendix no. 2 to ToR and 2a (if applicable).
2. List of persons directed by the Contractor for realization of the public order, in particular, those responsible for the provision of services, managing construction works, performing functions according to the requirements specified in Chapter VI point 3.4, in accordance with Appendix no. 6 to ToR.
3. List of construction works conducted no earlier than in the period of last 5 years and if the period of business activity is shorter - in that period, along with indication of their type, value, date and place of conduct as well as entities for which these works were conducted and enclosure of proofs specifying whether the construction works were conducted properly, whilst proofs as specified above shall be reference letters or other documents elaborated by the entity for which construction works were conducted and if the Contractor, due to reasons independent from him, is unable to obtain such documents - other applicable documents in accordance with Appendix no. 7 to ToR.
Pursuant to Art. 455 sec. 1 point 3 of the Act on Public Procurement the Ordering Party reserves the right to order additional construction works which have not been considered in the basic order to the so far contractor

Appeals may be submitted within 10 days from the date of sending of information concerning actions of the Ordering Party which constitute the basis for such a submission - if information was sent with the use of electronic communication means, or within 15 days if it was sent in another form. 2. Appeals with respect of the content of the notification initiating the proceeding for granting the order or with respect of the content of the documents concerning the order must be submitted within 10 days from the date of publication of the notification in DUUE or placing order documents on the website. 3. An appeal against actions other than those specified in points 1 and 2 must be submitted within 10 days from the date in which information was obtained or could be obtained upon maintaining due diligence on the circumstances constituting the basis for its submission. 4. If the Ordering Party did not publish the notification on intention to conclude agreement or despite such obligation he did not send the Contractor notification on selection of the most beneficial offer, an appeal must be submitted no later than within 30 days from the date of publication in DUUE of notification on the result of the proceeding and 6 months from the date of agreement conclusion should the Ordering Party fail to publish in DUUE of the notification on granting the order.
